Attorney Firms are NOT immune from lawsuits!

Attorneys can and do make errors and/or omissions like everyone else. To make matters worse, their practice areas can put them at a higher risk for lawsuits. Some of those areas of practice are Taxes, Securities, Corporate, Trusts & Estates, Business Transactions, etc. Additional items can cause claims, including missed deadlines, poor communication, conflict of interest, and clerical errors. There is no such thing as a small mistake. That small mistake can end up in a significant claim and could cause the attorney firm to suffer significant financial hardship.

CLAIMS EXAMPLE

An attorney failed to timely serve a complaint in a matter involving social security benefits. The attorney was then faced with the dismissal of the client’s appeal of a Social Security claim denial. The attorney took advantage of the policy’s pre-claim assistance coverage and reached out to the carrier to discuss claims repair options.

In collaboration with the attorney, the carrier engaged local defense counsel to research and draft a Good Cause Memorandum. Within 48 hours of the attorney contacting the carrier, the Court granted the request for additional time to serve the complaint. The matter then proceeded in the usual course.
